The increasing scope and complexity of environmental and land use laws can turn a routine residential or commercial project into a slow moving, expensive process. Environmental issues can arise under MTCA and CERCLA when a property is found to be contaminated, and in turn can trigger insurance coverage issues. Or, a interested party may pursue judicial review of a land use decision, by filing a Land Use Petition Act (“LUPA”) appeal in the superior court.
